Privacy Policy

This Privacy Policy applies to all personal information collected by Pixtd Pty Ltd trading as Pixtd (ABN 48 648 027 543) (referred to as “we”, “us”, “our” and similar grammatical forms) via the mobile application Pixtd (the Application).

We appreciate that your privacy is important to you we will continue to protect, manage or otherwise deal with your personal information in compliance with the Privacy Act 1988 (Cth) (Privacy Act) and the Australian Privacy Principles (APP).

The Privacy Act currently defines "personal information" as meaning information or an opinion about an identified individual or an individual who is reasonably identifiable:

1. whether the information or opinion is true or not; and

2. whether the information or opinion is recorded in a material form or not.

If information does not disclose your identity or enable your identity to be ascertained, it will in most cases not be classified as "personal information" and unless otherwise stated will not be subject to this Privacy Policy.

The kind information that we collect from you will depend on how you use the Application although we generally collect the following information from you:

1. personal information you voluntarily provide when you create an account on the Application, including but not limited to, your name, date of birth, address, telephone number, email address;

   (Primary Personal Information)

2. personal information about how you use and interact with the Application, including:

   1. information identifying how and when (including the frequency and duration) you create, share or interact with any content (including sponsored content), features on the Application;

   2. information identifying the people, accounts and hashtags that you are connected to, and how you and when you interact with them on the Application; and

   3. information identifying how you use and interact with any product or services offered on the Application.

   (Secondary Personal Information)

3. information from and about your mobile device that allow us to receive such as access to your GPS location, camera and photographs (Other Information).

4. Unless we have your implied or express consent or are required to do so by law, we will not collect information about your health, ethnicity, religious or political beliefs, sexual preferences, criminal record, and biometric data (Sensitive Information). 

5. Depending on the way that you use the Application, Sensitive Information may be collected. However, your Sensitive Information will only be collected where it is reasonably necessary for the services that we provide to you and where you choose to provide the Sensitive Information to us.

6. If allowable under your local law, we may collect Sensitive Information about you to enable face, fingerprint or voice recognition technology or other features that improve useability or enjoyment of the Application for you, should you elect to allow any such function on the Application.

7. Where you elect to enable face, fingerprint or voice recognition technology or other features that improve useability or enjoyment of the Application, you consent to the collection of that Sensitive Information.

8. If you do not choose to provide us with the above information, you will not be able to create an account on the Application, use the Application or access the products, services or all the features offered on the Application.

We collect Primary Personal Information about you when you create an account, seek assistance with any account management query or issue that you may have with your account on the Application, or provide any quality assurance feedback to us about the Application or its product or services.

We automatically collect and hold Secondary Personal Information, Other Information and Sensitive Information about you when you use and interact with the Application and its products, services or features.

We collect, hold and use Primary Personal Information about you in order for you to create an account on the Application, to provide access to the Application or its products, services or features, to provide assistance with any account management query or issue that you may have with your account on the Application, respond to any quality assurance feedback to us about the Application or its product or services and/or otherwise.

We collect, hold, use and disclose Secondary Personal Information, Other Information and Sensitive Information about you in order for us to:

1. create a personalised and tailored experience for you by offering, promoting or delivering personalised products and services (whether ours or those of a third party), features or content and make suggestions concerns these items that you may be interested;

2. monitor and surveillance user conduct to ensure safety, security and compliance with user guidelines such as the terms and conditions of use for the Application; and

3. provide analytical feedback to advertisers about your engagement and interaction with products and services offered by them on the Application by measuring the performance (distribution and effectiveness) of their advertisements among certain demographics to help them identify and best understand their key audiences.

We use different technologies and procedures to help protect personal information from unauthorised access, loss, alternation, disclosure or use. Some of the safeguards we use are user access controls, information firewalls and access authorisation controls to where your personal information is held in data centres. We also use data encryption when personal information is transferred to and from our service providers.

Our commitment to data security means:

1. we have procedures to limit access to personal information within our organisation;

2. we use security measures and technologies within our organisation to protect your personal information; and

3. we use service providers that can establish that they have secure controls relating to software security, access security and network security, including where credit card information is being transferred.

We are happy to provide you with details of the personal information that we hold about you. 

APP 12 allows you to get access to, and correct, the personal information we hold about you. You may access, edit or modify most of this information by logging into to your account and navigating to your account settings. Alternatively, you can contact us in writing directly (details below). 

APP 13 allows you to ask us to take reasonable steps to correct any personal information that is inaccurate, out of date, incomplete, irrelevant or misleading. If you believe that your personal information is inaccurate, out of date, irrelevant or is misleading, you can inform us of your complaint by writing to privacy@pixtd.com and we will attempt to resolve the matter.

If you are not satisfied with the outcome of your complaint, you may refer the matter to the Office of the Australian Information Commissioner (OAIC).

Your personal information may be transferred overseas or stored overseas for a variety of reasons. It is not possible to identify each and every country to which your personal information may be sent. If your personal information is sent to a recipient in a country with data protection laws which are at least substantially similar to the Australian Privacy Principles, and where there are mechanisms available to you to enforce protection of your personal information under that overseas law, we will not be liable for a breach of the Australian Privacy Principles if your personal information is mishandled in that jurisdiction. If your personal information is transferred to a jurisdiction which does not have data protection laws as comprehensive as Australia's, we will take reasonable steps to secure a contractual commitment from the recipient to handle your information in accordance with the Australian Privacy Principles. 

You accept the terms of this Privacy Policy and provide us with your consent to collect, hold, use and disclose the various types of information about you in accordance with this Privacy Policy by:

1. using, browsing and/or reading the Application which signifies that you have read, understood and agree to be bound by the Terms; and/or

2. clicking to accept or agree to the terms of this Privacy Policy where this option is made available to you in the user interface of the Application.

You are not permitted to use and must immediately cease usage of the Application or any of its products or services if you do not accept the terms of this Privacy Policy or provide us with your consent to collect, hold, use and disclose the various types of information about you in accordance with this Privacy Policy.

If we decide to change this Privacy Policy, we will post those changes on this page, and update the Privacy Policy modification date below.
